Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, products, and services (collectively, “Services”) operated by Score Watch (“Score Watch,” “we,” “us,” or “our”). By accessing or using the Services, you agree to be bound by these Terms.

1. Who we are

Score Watch is an independent research product that monitors the FICO mortgage scoring franchise and the competitive landscape around credit scoring in housing finance. We are not affiliated with, sponsored by, or endorsed by Fair Isaac Corporation. FICO® is a registered trademark of Fair Isaac Corporation, used under nominative fair use for identification and commentary.

2. Eligibility

You must be at least 18 years old and have the legal authority to enter into a binding contract to use the Services. If you are using the Services on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

3. Accounts

Some Services require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. Score Watch is not liable for any loss or damage arising from your failure to maintain credential confidentiality.

You may not share your account credentials with any other person. Each subscription is for a single user unless explicitly licensed otherwise.

4. Subscriptions and payments

Score Watch offers paid subscription plans. By subscribing, you authorize us to charge your payment method on the schedule described at the time of purchase (typically monthly or annually). All fees are stated in U.S. dollars unless otherwise specified.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel at any time through your account page or by emailing legal@score-watch.com. Cancellation stops the next billing cycle; no refunds are issued for the current period.

We may change subscription pricing with at least 30 days' written notice. Pricing changes will not affect your current billing period.

5. Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract the source code or underlying methodology of the Services;
• Use automated tools (scrapers, crawlers, bots) to access or extract data from the Services, except for legitimate search-engine indexing of public marketing pages;
• Resell, sublicense, or redistribute Score Watch data or research, in whole or in part, to any third party;
• Use Score Watch data or research to construct a competing product or service;
• Share your account access with any other person;
• Use the Services in any way that violates applicable law or regulation, including but not limited to securities laws.

We reserve the right to suspend or terminate accounts that violate these provisions, with or without notice, and to seek any other remedies available at law or in equity.

6. Intellectual property

The Services, including all content, design, and underlying methodology, are owned by Score Watch and protected by copyright, trademark, and other intellectual property laws. You receive only a limited, non-exclusive, non-transferable license to use the Services for the purposes described in these Terms.

The Score Watch name, logo, and all related marks are trademarks of Score Watch. You may not use them without our prior written consent except as permitted by nominative fair use.

7. Data and research disclaimer

Score Watch publishes research and data products for informational purposes only. Our content does not constitute investment advice, a recommendation to buy or sell any security, or a solicitation of any kind. Score Watch is not a registered investment adviser, broker-dealer, or fiduciary.

We make commercially reasonable efforts to ensure the accuracy of our research and data. However, we do not warrant that any content is accurate, complete, current, or fit for any particular purpose. You are solely responsible for any decisions you make based on Score Watch content, and you assume all associated risks.

8. No warranty

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCORE WATCH'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO SCORE WATCH IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL SCORE WATCH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS.

10. Indemnification

You agree to indemnify, defend, and hold harmless Score Watch from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Services in violation of these Terms, (b) your violation of any law or regulation, or (c) your infringement of any third party's rights.

11. Termination

We may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice, including for breach of these Terms. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will survive.

In the event Score Watch ceases operations, we will provide active subscribers with a final export of their historical data within 30 days of public shutdown notice, to the extent technically feasible.

12. Governing law and disputes

These Terms are governed by the laws of the State of [Delaware/your state], without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in [COUNTY, STATE], and both parties consent to the personal jurisdiction of those courts.
